This agreement is a legal document that outlines your and our rights and obligations in respect
to the services/goods/products provided by Bidforme.com.au

If a person is a resident of a country or state that does not permit or allow its residents to participate in an on-line auction service, then that person should not apply to become a member, or use the site.

Please read all the Terms & Conditions before joining. Becoming a member of Bidforme.com.au indicates that you have read and agree to all the Terms & Conditions stated below.

There are certain countries and states as is the case in Victoria, Australia that do not allow you to either join or bid or win on these types of auction websites. These are Penny Auction and Unique Bid Auction websites. It is totally your responsibility to know your own country and state laws and not that of Bidforme.com.au Actions or any member of it's staff.

If you do join and bid or win anything on our website and it is found to be that you are in one of these areas that you accept total and full responsibly for your own consequences and that Bidforme.com.au Auctions will be in no way at fault for your lack of knowledge on this matter. By bidding and/or winning any items from one of these places you also understand that no refund will be made of any kind on bids that you placed on our website and that if you are a winner that that item it will go the next Lowest Unique bid Offered.

All Terms & Conditions contained herein solely apply to the Internet website onBidforme.com.au, its employees and users. By signing up for an account and participating in the service available, users are agreeing to abide by all terms and conditions that follow.

Should any member be found giving us false or fraudulent information, we reserve the right to cancel the membership without prior notice and or block that member's IP address from being able to re-register again withBidforme.com.au

The word Unique is used on our website for the purposes of describing the Lowest Unique Bid offer made. This means a bidder that has placed (For Example only) 73 cents would have to be the only bidder to have made that bid offer and also be the lowest of all unique bids to win the item. This is the same throughout our entire website for all items sold.

The Lowest Unique Bid is the lowest bid placed that has not been duplicated by any other player/bid.

Bid offers can range from 1c to the "Max Bid Amount" allowed of that particular item and you can place as many bids as you like on any one item.

Two or more Bids that are the same do not constitute as being a Unique Bid.

The auction closes when the allocated amount of total bidders has been reached, each auction will be allowed to run it's full coarse till the total amount of required bids are reached and the required amount reaches to 0. This is to give each and every participant an equal opportunity to win the lowest unique bid and win the right to purchase the item at the lowest unique bid that was put forward as the winner. Under certain circumstances the required amount of bids may be reduced to close the auction quicker in order to find a lowest unique bidder for that item.

All third party use of this website is illegal and will never be accepted by us for any reason. Letting some-one else use your log-in details is a breach of the privacy act and will result in the cancellation of your membership.

Under no circumstances are you allowed to discuss your bid offer with any third party or with any other member of Bidforme.com.au whether a member of your own family or not.

If it is ever found that you have discussed this, your membership will be cancelled instantly and you will lose all rights to any items you may win. Plus you will not receive a refund for bid offers already in placed on Un-closed items.

Any type of mis-use can or will result in us contacting both Police and Fraud authorities and any other agent we feel will help solve any wrong doing.

House holds can register multiple accounts if they wish but can not use the same email address, password, and Username as your registration process will be denied by our system if you do.

Some items are only bought once the auction has been completed. We do this so you receive the full term of that items warranty with your item, as in some cases auctions may run for several months. For example an item may have 12 months warranty on it if we kept that item in stock and if the auction ran for 4 months and you won that item you would only be getting 8 months warranty on the item as 4 months has passed since the auction began on that item, in order to prevent this from happening and in order for the auction winner to get the full warranty on an item, the items are generally bought at the end of the auction so you get the full balance of the warranty.


How to use our site


This Auction site is not like typical auction sites where the more/higher you bid the better chance you have of winning/buying that item.Here at Bidforme.com.auwe do not want your highest bid here ever,only your lowest Unique Bid wins the auction.

What we want here is yourLowest Unique Bid. We want to know what is the lowest you are prepared to pay for any item that is onBidforme.com.auwhether it be a Car, an X BOX, TV, White Goods, new or used Items and even on a house or other property sold through our website.


SIMPLIFIED OUTLINE

By becoming a member ofbidforme.com.au, you are bound by the terms and conditions of this agreement. This agreement documents the following aspects of participating in a bidforme.com.au auction;

a) How to become a bidforme.com.au member;
b) How to place a bid in a bidforme.com.au auction;
c) How the successful bidder is determined in a bidforme.com.au auction;
d) How the successful bidder is notified by bidforme.com.au;
e) What the successful bidder is required to do in order to purchase an item; and
f) How the item will be forwarded to the successful bidder

ENTIRE AGREEMENT

This Agreement sets forth the entire agreement and understanding between the parties as to the subject matter of this Agreement and neither of the parties shall be bound by any conditions, definitions, warranties or representations with respect of the subject matter of this Agreement other than as expressly provided herein.

To the extent that the Trade Practices Act 1975 (Cth) imposes warranties (Commonwealth warranties) inconsistent with the warranties contained herein, such Commonwealth warranties will prevail to the extent of any such inconsistency.

Bidforme.com.auspecifically disclaims any implied warranties of title merchantability and fitness for a particular purpose for the products sold, except as provided for in clause 3 (above).


SEVERANCE

In the event of any part of this Agreement being or becoming void or unenforceable, then that part shall be severed from this Agreement.


ACCEPTANCE OF TERMS AND CONDITIONS

If you do not agree with the terms and conditions contained herein then you should not apply to become a Member, or use the site.

By placing a Bid and paying the Admin Fee, the Member acknowledges that they are aware and agree to the bidforme.com.au Terms and Conditions and Privacy Policy.

As the Terms and Conditions may change from time to time, the Member should update their knowledge of the terms regularly.

By accessing and using this site you agree to be bound by the Terms and Conditions of this agreement.

By applying to become a Member you acknowledge that you have read and accepted these Terms and Conditions.

Membership

1. Membership of bidforme.com.au is open to all Australian citizens over the age of 18 years
provided that Membership of bidforme.com.au is permitted by the laws of the State within which a Member resides.

2. Members warrant that the information they provide is true and correct.

3. All Members agree to abide by the Terms and Conditions of this Agreement and the procedures (if any) stipulated for any particular Auction format.

4. Membership to Bidforme.com.au is free.

5. The membership Join Now form is available via the website.
6. Applicants warrant that the information they provide is true and correct.

Activating Your Account

After the Join Now form has been completed and submitted,
an email will be sent to the email address specified on the Join Now Form.
Applicants will be required to click on the activation link in this email.
After this link has been activated the Members account will be active and ready for use.


Transactions

The Member warrants that they are the holder and authorized user of any credit cards
and or accounts used to pay for the admin fee from their Member account.

Auction

Bidforme.com.au Auction

Bidforme.com.au will determine the following for each specific Auction:

  • Product or Service being sold
  • Administration Fee payable on each Bid
  • Maximum Bid Amount
  • Value Recommended Retail Price
  • Required number of Bids to close the Auction


Reducing Required Number of Bids

Bidforme.com.au may reduce the Required number of Bids for any specific Auction in progress should the number received be deemed by Bidforme.com.au to be an acceptable level to close the Auction.


Bidding

Accepting a Bid

Bidforme.com.au will accept a Bid in an Auction if the Bidder:

a.is a Registered Member of Bidforme.com.au
b.has entered a valid Bid amount
c.has paid the Administration Fee
d.has not breached the Terms and Conditions

Restrictions on Bidding

The following restrictions are placed on all Bidforme.com.au Auctions:

a.All Bids must be placed by an individual
b.Computer generated Bids will be constituted invalid
c.Members must be aged eighteen (18) years or over


Making a Bid

Bidforme.com.au Members may Bid on any Auction in progress by clicking on the Bid Now button on the Auction lot.

a.The Administration Fee will be payable at the time of clicking on the bid now button, once you have clicked on this button, a paypal window will open up where you will need to pay for the admin fee by credit card / debit card. Once you have submitted payment details and click ok, you payment will process, then you will need to click on the link on the paypal window to return to our site so you can then continue to place your bid. Paypal is a secure payment gateway that is used by millions of people across the world and is the most secure payment gateway on the internet today.
b.A Member may not cancel, withdraw or alter a Bid after it has been submitted.
c.All Bids are in Australian Dollars and are inclusive of GST.
d.Once a Bid has been submitted the Member will receive one of the following Bid status messages:

1.You are currently the Lowest Unique Bid
2.Your bid is Unique but not the Lowest
3.Your bid is not Unique
4.You have entered an invalid amount.

e.Bids are sealed so other Bidders cannot see what you have Bid.
f.Bids are processed in the order they are received into the database.
g.A Member must not in any circumstances disclose details or collude with another Member during
the course of an Auction.
h.By submitting a Bid the Member acknowledges that they are entering into a legally binding contract for the purchase of the Auctioned Products or Services.
i.The Member acknowledges that they are aware of the Bidforme.com.au Terms and Conditions.


Cancellation of Bids

Bidforme.com.au may cancel placed bids forany of the following reasons:

a.Fraudulent activity is suspected.
b.Fraudulent credit cards or accounts have been used to participate in an auction
c.The bank or other credit institution reverses the credit transaction.
d.The Member has provided false information when joining.
e.The Member colludes with another Member
f.Any breach of the Terms and Conditions.

Concluding an Auction


Bidforme.com.au will conclude an Auction after the Required number of Bids has been reached.

Determination of the Successful Bidder

a.The Bidder that submits the Lowest Unique Bid that has been accepted by Bidforme.com.au will be declared by Bidforme.com.au as the Successful Bidder.
b.Should there be no Lowest Unique Bid, the Successful Bidder will be determined by the Lowest bid amount with two (2) Bids. The Bidder who was the first to place a Bid for this amount will be declared by Bidforme.com.au as the Successful Bidder. If there are no two (2) Bids the same, this process will be determined on three (3) Bids of the same amount, this process will continue until a Successful Bidder is Determined.
c.Once the Successful Bidder has been determined, Bidforme.com.au will notify the Member by email.
d.The Successful Bid amount will then need to be paid via paypal to claim your auction item.

Auction Results

After the close of an Auction, results will be displayed on the Bidforme.com.au Website for all Members to view.

Delivery of Products or Services

a.Product or Service dispatch will take place within seven (7) days, unless otherwise stated in correspondence from us.
b.Delivery and damage in transit insurance within Australia is free of charge and paid for by Bidforme.com.au.
c.Delivery and damage in transit insurance to New Zealand will be charged to the Member at cost price.
d.Delivery of certain Products or Services may be arranged directly with Suppliers and Bidforme.com.au. Members will be notified by email and proof of identity will be needed when collecting and signing proof of delivery for these items.
e.Installation costs are not included. Bidforme.com.au does not undertake to install any products sold.

Warranty and Guarantee

a.All Product Warranties are provided directly by the manufacturer.
b.Please inspect Product before signing the Proof of Delivery.
c.If a Product has been damaged in transit, (upon receiving conformation from the transit insurance company) Bidforme.com.au will organise a replacement product.
d.If the Product supplied to the Bidder does not comply with the description of the Product Auctioned, then the Bidder may within fourteen (14) days of receipt, return the Product in the condition it was supplied. Bidforme.com.au will refund in full and without deduction the winning Bidder's Successful Bid Amount.
e.Bidforme.com.au is not liable for any defect caused by fair wear and tear, careless or improper handling, non-adherence to operating instructions, improper installation or any other abuse or misuse by the Member or third party.
f.Refunds, Returns or Replacements do not include delivery and insurance charges,
these charges are at the expense of the Member.
g.Except to the extent that is required by law, Bidforme.com.au is not responsible for the quality of the product, its fitness for purpose, its faults and or unsuitability causing loss or damage to the user.
h.Where an advertised Product or Service is not available for any reason (example: has been superseded by a newer model), Bidforme.com.au will replace this item with another similar item of equal or greater value.

General Terms and Conditions

a.Bidforme.com.au is not an authorised retailer, dealer or agent of any manufacturers,
suppliers or distributors of products advertised on this website.
All reference to manufacturers and their products are for identification purposes only.
All trademarks are the registered trademarks of their respective companies.
Furthermore, they do not control, endorse, sponsor, affiliate or associate with Bidforme.com.au in
in any way.
b.No agency, partnership, joint venture, employee-employer relationship or franchiser-franchisee relationship exists between you and Bidforme.com.au.
c.All information, text, material, graphics and advertisements on the Website are protected by Australian and International copyright and trademarks.
d.Any Bidforme.com.au Auction that is not capable of running its full course due but not limited to infection by computer virus, bugs, technical failures, unauthorized intervention, fraud, war, terrorism, state of emergency or any event beyond our control, We reserve the right to cancel, terminate, modify or suspend the Auction.

Liability

a.Bidforme.com.au is not liable for your actions. You agree and warrant to act in a lawful manner and in accordance with the laws that apply to you.
b.Bidforme.com.au is not liable for lost data, profits, business, revenue, incidental or consequential damages arising from or in connection to Products or Services Auctioned, or use of the Website.
c.Bidforme.com.au is not liable for any hardware, software or any other technical difficulties.
d.Bidforme.com.au shall not be liable for any failure to perform its obligations under this agreement caused by matters beyond its reasonable control.
e.Bidforme.com.au is not liable for any third party controlled website which may be accessed by ways of a link from our Website. No warranty or representations are given that these links are virus free or that the content is accurate, complete, accessible or are fit for any particular purpose. You link to any such website at your own risk.
f.Bidforme.com.au is not liable for any personal injury or death caused as a result of using the Website, Product or Service offered on Auction, except for any liability which cannot be excluded by law.
g.Bidforme.com.au shall not be liable for security of third party payment service providers and the transfer of sensitive information over the internet.
h.Bidforme.com.au will not be liable for any misstatement, error or omission with regard to the description of Products or Services on the Website.

Personal Information

a.Members are responsible for all activities that occur under their account. Including security of login details and passwords.
b.Members must notify Bidforme.com.au immediately they suspect unauthorized use of their account or any other breach of security. Remember to log out of your account after each session.
c.Bidforme.com.au collects your personal information when Joining and using this Website.We use this information in the day to day running of the Website Including but not limited to emailing of Bidforme.com.au promotional material, Auction results, and general Member contact.
d.Bidforme.com.au reserves the right to publish the Member name of the Successful Bidders on our Website and other promotional material.
e.Bidforme.com.au will not sell or give out personal Member information to any third party except where it is required by law enforcement or government authority.
f.This information is protected under the Privacy Act 1988.
g.Phishing warning: A fraudulent phishing website impersonates a legitimate website to lure unsuspecting visitors into divulging personal information. Bidforme.com.au will never send you an email asking you to enter/verify your Member details. If you receive what you believe to be a fraudulent email, please contact Bidforme.com.au via our email.

Indemnity

You agree to indemnify and hold Bidforme.com.au, its subsidiaries, affiliates, offices, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your use of the Website or links.

Severance

a.If any provision of this agreement shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this agreement, which shall remain in full force and effect.
b. If any provision of this agreement is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted or amended, the provision in question shall apply with such modifications as may be necessary to make it valid and enforceable.

Breach of Terms and Conditions

a.If you violate these Terms and Conditions, Bidforme.com.au may terminate your use of the Website and in some cases take legal action against you for loss or damage.
b.These Terms and Conditions and Website Auctions are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms and Conditions, the Website, any Auction, Product or Service must be submitted to the jurisdiction of the courts of New South Wales.

Cancellation of Membership by Member

1.A Member may cancel their bidforme.com.au Membership at any time, as long as they do not have any bids in place with an active Auction.
2.A Member can request the cancellation of the Membership by sending an email to bidforme.com.au.
3.Any remaining Promotional Credits or bidforme.com.au cash shall be forfeited by the member.


Cancellation or Suspension of Membership byBidforme.com.au

bidforme.com.au may cancel or suspend Membership due to a breach of the Terms and Conditions by the Member, or at the sole discretion of bidforme.com.au.


The Bid Process

The bid making and payment process is described in Appendix I of this Agreement.


Making a Bid

1.To make a Bid, a Bidder must be a current Member of bidforme.com.au and aged 18 years or over.

2.A Member can place a Bid on any active Auction by clicking the "Bid Now!!" button on the Auction lot.

3.A Member can place a maximum number of Bids on any auction, which is stated by the Max Bids Per Bidder' tab, displayed in the auction lot.


Admin Fee

Each Bid attracts an Admin Fee, payable by the Member. Admin fees are paid via paypal payment gateway which is the most secure and trusted payment system that is used today by millions of people daily.

All our items sold on Bidforme.com.au Auctions website have what we call an Administration fee. This fee is the fee that is paid by all bidders when they place a bid on any item.

The Administration fee is what is used to pay for the item you are getting for your lowest unique bid offer, plus it pays for all the extras we add towards an item like stamp duty fees, lawyer fees, postage etc if any.

On top of that we also add our fee which can vary from item to item because we have to take into account how long an item may be going for and this cost will come down as we see items going quicker, basically the quicker an item can be finalized the cheaper our fees will be on the next item as search engine optimization and advertising on goggle, yahoo etc, costs thousands of dollars a month, Our largest cost is search engines per month.

Unlike most other websites similar to this one, our website does not control the closing of an item by way of time but by reaching the full allocated "Required Bids" set on each item.

Once an item reaches the full amount of bids required it closes automatically and within a few minutes to 24 hours informs the winning bidder with the lowest unique bid of their purchase.

All closed items bidding progress can be viewed by any member after the closing has been finalized which can take up to a week. This gives the opportunity for all members to see that we are not cheating anyone and that all bids placed are honest at all times.

Anyone and everyone is eligible to bid on our website as long as they comply with the Terms & Conditions of our website and we also suggest you to read the Frequently Asked Questions to better understand how our auctions work.

Their are some countries or states that don't allow you to bid on these types of websites. It is totally your responsibility to know this and we can not know exactly which countries or states these are.

Bidding on an item does not give any bidder the right of ownership on that item in any way what so ever. All bids are placed with the understanding that only the winning lowest unique bid will have total ownership of that item after he/she has accepted to pay the bid offer that was placed by them. At no point will any other bidder have any say or any claim on any ongoing or closed auction for any reason what so ever.

The admin fee on all items is designed to pay for the following features of that item:

A-Value price of the item.
B-Postage fees if details state "Fee Postage".
C-Any transport fees to the item (example) We will fly you from anywhere in Australia to your new car or house(end Of Example).
D-Stamp duty fees when selling houses.
E-Lawyer fees up to $5000.00 au if stated within the details of that item.
F-Our costs for running, advertising and searching for items.
G-Wages for our employees.
H- Search engine website advertisements, billboards, radio and television advertisements etc.

Only the fees that correspond with any particular item are added within the Admin fee structure of that item. Buyers please be sure to read allTerms & Conditionsand all of the items description details and postage costs before bidding, as by bidding you are saying that you did read them and understand what you read and agree that you accept being under a legal contract under Australian auction laws unless otherwise stated within that items description panel.

Remember that when buying an item on Bidforme.com.au that all you pay to buy that item is the low unique bid offer you made and not the value of the item you see in the items box underValue Price.The admin fee is paid by everyone that wants to participant in placing a bid. The lowest unique bid that you put forward is only ever payable by the auction winner who has the lowest unique bid and not payable by anyone else.

This means we will pay your new home's stamp duty and lawyer fees for you by sending a solicitor of your choice the money via cheque for the transfer contracts for purchase of the property. So all you have to do is pay your winning lowest unique bid offer of (example only)$0.87au and sign on the dotted line of your new home it's as easy as that, mortgage free, debt free, not a cent more to pay.

So do not waste any time placing your bids in and securing your position within the auction process as the Lowest Unique Bidder of a (example only)$500,000.00 home. The longer you wait the more chance you have of not getting it.


Placing a bid

Each items box is laid out like the example below.

Value: $2,000
Admin fee: $4.50
Required Bids:1,000
Bids Remaining: 426

Value;is the estimated cost of the item you would pay for in a store (new items). For second-hand items, it is the cost of what Bidforme.com.au thinks it should sell for if it were to be sold in a normal auction.
Admin Fee;is the cost of the item plus our administration fee for looking after, placing the item and any of our services required to manage the sale of the item. This will vary depending on the price of the item.
Required Bids;is the number of bids set by our administration to cover all costs, but also to determine the cheapest fee you will need to pay to make a bid offer.

Bids Remaining;is the amount of bids needed to be made for that item to close and the auction to end to determine the lowest unique bidder.

Depending on the amount of Required Bids asked for, which is determined by the price of the item, an auction may go for as short as 1 week to as long as several months or longer. The auction closes when the Bids Remaining reaches 0.

When you have found an item that you wish to bid on you will need to first click on BID NOW within that items box which will take you to another screen where you can decide how much you would like to bid.

Remember we want your Lowest Unique Bid Offer,so think of a low unique amount that you feel is what you would pay for the item and place it in the box. Remembering that it has to be a Unique Bid offer for you to win the item.

The sole purpose of a lowest unique bid auction is that if you are the lowest unique auction winner you win the right to purchase the product or asset at your lowest unique bid price you put forward. That's how unique bid auctions work, unlike traditional the form of auctions where it is the highest bid put forward is the auction winner. In lowest unique bid auctions everyone has an equal opportunity to win the right to purchase items at a very low price as low as a few cents or dollars.

By clicking on BID NOW button, at this point you agree to pay for theAdmin feefor placing your bid.

Once you click on BID NOW after placing your bid offer, you will be told if you are:

A.Your bid has been placed.It is currently the lowest Unique Bid. Please watch till the auction finishes if you have won the product. You will receive an e-mail if your bid has been beaten.

B.
Your bid has been placed. but unfortunately it is not the lowest unique bid.
To win, please try again.

It will be up to you to choose what to do next. You will receive an email for each bid you make and can keep track of all your bid offers in the Site Map.
Our auctions are not time limited based but are set to end when the amount of required bids allocated by us has been reached which then closes the auction on that item.

So please be aware that this can be anything from a week to a month or more.
Once the full "Required Bids" amount on an item has been reached the auction will close and we will then search for the lowest unique bid offer made by those bidders that participated within that items auction.


Acceptance of Bids

A Bid will only be accepted if payment of the Admin Fee has been recorded as a received payment in the bidforme.com.au system.

Auction Results

In a Lowest Unique Bid Auction, the Successful Bid will be displayed for viewing in the Results tab.

Cancellation of Bids

Bidforme.com.aumay cancel any Bid without making a refund of the applicable Admin Fee(s) in any one or more of the following circumstances:

1.The Bidder has provided or provides false, misleading or invalid information when becoming a Member, or when placing Bid.

2.A fraudulent credit card is used by the Member to pay for the relevant Admin Fee.

3.The Member or Bidder's bank or other credit institution reverses or disallows the credit card transaction for the payment of the admin fee(s).

4.Any other breach of this agreement.


Determinations of the Successful Bidder

An example of how the Successful Bidder is determined in a Lowest Unique Bid Auction is described in Appendix II of this Agreement in more detail.


Lowest Unique Bid Auction.

1.In a Lowest Unique Bid Auction, the Successful Bidder is the Member that places the Lowest Unique Bid for that particular bidforme.com.auAuction Item.

2.The Successful Bidder has the right to purchase the Item for the Bid Amount determined as the Lowest Unique Bid.

3.Should there be no Lowest Unique Bid, the Successful Bidder will be selected from the Lowest Bid Amount with exactly two Bids, with the Bidder who entered their Bid first being selected.

4.If there is no Bid Amount with exactly two Bids, then the process of determining the Successful Bidder is repeated for the Lowest Unique Bid with exactly three Bids, and so on, until there is a Successful Bidder.


Notification to Successful Bidder


1.The Successful Bidder will be notified by bidforme.com.au,via the contact details they have provided (which will normally be by email), that they have the right to purchase.

2.It may take up to 5 business days from the End Date until the Auction Results are announced.

 

Confirmation by Successful Bidder

1.After you have been informed of becoming a Successful Bidder, you will have 3 business days to decide whether you wish to purchase the Item at the Bid Amount you have offered.

2.After we have informed you of being the Successful Bidder, and if you decide that you do not wish to purchase, no further action will be required by you, or you can confirm this by clicking Decline' in the My Successful Bids' section.

3.If we have not heard from you within 3 business days of notifying you by telephone, email, or by leaving a recorded message, we reserve the right to assume you will not accept.


Potential Auction Variations

1.If the Required Number of Bids in any bidforme.com.auAuction have not been received by the End Date, at its sole discretion, bidforme.com.au may extend the End Date of the Auction.

2.If the Required Number of Bids in any bidforme.com.auAuction has not been received by the End Date, bidforme.com.auat its sole discretion, may cancel the Auction.

3.bidforme.com.au may reduce & increase the Required Number of Bids for any Auction in progress.

4.If for any reason the Auction is not capable of running as planned, due to any reason, including anything which may corrupt the integrity or proper conduct of the Auction, bidforme.com.au reserves the right to cancel, terminate, modify or suspend the Auction.


Payments, refunds and forfeits

Payments by Members

1.The Bid Amount is only payable by the Successful Bidder, after the conclusion of the relevant Auction.

2.Following bidforme.com.au informing you that you have become the Successful Bidder, and you confirm to bidforme.com.au within 3 business days that you wish to go ahead with the purchase, payment for the Item is due within 2 business days of your decision.

3.Payment must be made by bankers draft, bank transfers, money order or via Paypal.

4.In the event of late payment by the Member of the Bid Amount, interest at the rate of 3%pa may be imposed by bidforme.com.au on the Bid Amount.

Refunds by bidforme.com.au

1.Refund of the winning Bid Amount, after payment, shall be made in the event that supply of the Item cannot be fulfilled by bidforme.com.au, or by the supplier of the Item. Refunds do not include the relevant Admin Fee.

2.If the Item does not meet the description provided by bidforme.com.au, and is returned by the Successful Bidder to bidforme.com.au. Thenbidforme.com.auwill refund the winning bidder the full Bid Amount subject to the Item being returned in the same condition which it was supplied to the Bidder.

3.At its sole discretion, bidforme.com.au may replace the Item offered at Auction, with a similar Item, if in bidforme.com.au's opinion, the replacement Item will be of equal or comparable value.

 

Forfeiture by Member

Should the Successful Bidder fail to pay for the goods/service within 2 business days of confirming that they wish to purchase the Item, the right to purchase the Item at that Bid Amount, will be forfeited.

Auction Closing Notification

1.When an item closes, the winning buyer will be notified by email of his/her win. They will then receive a second email within 24 hours confirming that we are aware of their win and stating all amounts due.

2.This will include the final sale price (being your lowest unique winning bid, plus postal fees or delivery charges if stated in the items description.

3.The winner will then have 24 hours to confirm that he/she accepts the item and a total of 2 business days from the closing date to pay for the item.

4.If the winner accepts the item the winner will have to pay the lowest unique bid they made via paypal within 2 days of the auction closing. Once payment has been received by us we will confirm with you the delivery of the item.

5.If the winner refuses the item in writing by sending us an email then no further action will be taken with that participant.

6.In this case the item will be offered to the second lowest unique winning bidder who will be notified by email and also given 24 hours to confirm they accept the item. If they do accept, then all conditions from the first winner/buyer roll down to the second buyer/winner.

7.If for some reason the second buyer refuses the item, the third winning lowest unique bidder will be offered the item by email and they will also have 24 hours to accept. If they do accept, all conditions from the first and second winner/buyer roll down to the third.

8.
If the third refuses, we will keep the process of working up the ladder oflowest unique bidwinners until we find a winner that accepts the item.

9.All decisions made byBidforme.com.auwill be final and a copy of the bidding process from a closed auction will be visible to all members after a winner has been found and they receive the item.

10.No items can be taken or transferred to cash for any reason.


Accepting An Item You Won


1.Once you place a bid on any item within our website, you agree and accept that you have read all of theBidforme.com.auTerms & Conditions.

2.By bidding and accepting on any item, you are in effect signing a contract betweenyouandbidforme.com.auand become subject to normal contract laws unless otherwise stated on our website.

3.You are also accepting to either pay the postage fees or delivery cost if any,or pick up the item yourself. You are also accepting all other conditions laid out within the items description details.

2.Some contents/items being sold onBidforme.com.aumay be under patent and or copyright & trademark and these belong to their rightful owners.

3.In the event that items/material are in violation of patent and or copyright restrictions, it will be taken up with the user that is using the patented and or copyright/trademark items/material by the owner of the patented and or copyright/trademark items/material.


Policies On Fraud

1.Bidforme.com.auwill not tolerate any type off raud from any country for any reason. All account, information,IPaddresses and anything else relevant will be sent to the appropriate authorities for
further investigation if fraud is suspected.

2.Bidforme.com.aumake no guarantees that a user's information or identity is correct when they register with us and this is admittedly hard to track, but any such offenders giving false information will be suspended instantly following further investigation.

3.Bidforme.com.aukeeps a record of all IP addresses for the purpose of matching personal details to our data base.

4.All such personal information is kept private and on a separate computer from our website and will never be passed on to third parties for any reason other than to any relevant authorities if involved with activities such as fraud of any type and/or in the event they are requested by a member.

5.If a member is found committing any offenses and they are suspended for such offenses, all auction bids placed by them will be instantly ceased/cancelled without warning with no refunds of any money or credits owing.

6.We atBidforme.com.auwill not tolerate any type of fraud, attempts of fraud or anything to do with misleading another member for the purpose of obtaining either free items, money or personal information from another member or user ofBidforme.com.au


All Promotions

1.Bidforme.com.auat any time may hold or offer promotions or vouchers. These promotions will only be valid if they came from ads on our website, websites we advertise on, or in our newsletters.

2.A copy will need to be kept unless otherwise stated in those ads or in our newsletters (you may be required to supply either a link from which you saw the ad or a copy of the newsletter for verification).
3.Noother forms of promotions will be accepted byBidforme.com.aufor any reason. In other words, if it did not come from us it is not ours and will not be honoured. We keep a record of where all our ads go and a record of all our newsletters for reference.


Promoting and Advertising Won Items

1.We reserve the right to use any item that is won in any future advertisements involving Bidforme.com.au Auctions.

2.We would appreciate winners to allow themselves to be filmed when first receiving the item including before and after clips. Have change of life style interviews with us and any media we choose to advertise this great win.

3.In the case of winning a house we do reserve the right to have media present when you arrive off the plane, sign contracts, have keys handed over to you by us at bidforme.com.au and from inside when you walk in and include an interview about your thoughts of our website and your great life changing win.

4.We also reserve the right to post pictures/photos and video clips of your win on our website and use them for advertising purposes on any of our other websites or websites of our choosing.

5.All pictures and video will belong to Bidforme.com.au with no rights given to anybody else but will supply you the winner with copies of your photos and video clips for your own personal records.

6.Any pictures or filming after the day you have taken possession of your item you will have the right to refuse any and all interviews, photos and videos be taken by anybody.


Cash Auctions

1.All our cash auctions are designed to help both the Lowest Unique Bid winner and the community.

2.A percentage of all cash Auctions profit over the winning amount will be donated to Charity Organisations and listed within our website stating the name of the organization that was donated to and the amount donated.


Products and Deliveries

1.Unless otherwise stated, products which are for Auction on this site do not belong to bidforme.com.au.
2.Unless otherwise stated, goods delivered within Australia and New Zealand are shipped free of charge, and are insured by bidforme.com.au for damage in transit.
3.The cost of delivering the Item outside Australia is to be borne by the Successful Bidder.
4.If delivery charges are applicable to an Item being auctioned, the anticipated delivery charge will be advertised on the auction page.
5.At the close of the Auction, bidforme.com.au will notify the Successful Bidder of the applicable delivery charges including, but not limited to, overseas shipping costs, government taxes, excise duty and insurance charges within 3 business days of the declaration of the Successful Bidder.
6.Within 5 business days of the Successful Bidder's funds being cleared into bidforme.com.au's nominated account, bidforme.com.au endeavours to have the goods shipped to the Successful Bidder.
7.bidforme.com.au may not necessarily be the supplier of the goods and/or services. Delivery of the goods and/or services may be made directly from the suppliers and/or the producers and/or the importers and/or the service providers.
8.bidforme.com.au will endeavour to have any Item damaged in transit, replaced like for like, as soon as practicable.

Bid Back best endeavours

1.Bidforme.com.au will use its best endeavours to ensure that the description of the Items offered by way of Auction accurately reflect the condition, state and nature of that Item(s).
2.If the Item supplied to the Successful Bidder does not substantially comply with the description of the Item auctioned by bidforme.com.au, the Bidder may, within 30 days of receipt of the Item, return the Item supplied by bidforme.com.au to bidforme.com.au.
3.If the Member wishes to return the Item to bidforme.com.au, you should contact bidforme.com.au prior to transporting the Item.
4.If the Item to is to be returned to bidforme.com.au, by the Member, all costs (including, but not limited to transport and insurance) shall be borne by the Member.
5.In the event that the Item is returned by the Successful Bidder to bidforme.com.au,bidforme.com.auwill refund the Auction winner the full Bid Amount subject to the Item being returned in the same condition which it was supplied to the Bidder.


Breach of Agreement

You breach this agreement if you, or another on your behalf:
1.Do not comply with the Terms and Conditions and Privacy Policy;
2.Engage in fraudulent activity in connection with the bidforme.com.au site;
3.Provide any information that may be false, inaccurate or misleading;
4.Contravene any applicable law, statute, ordinance or regulation required to be observed by the member in relation to their participation in any Auction.
5.Introduce viruses, Trojan Horses, time bombs, easter eggs, worms or cancelbots that may detrimentally interfere with, modify, surreptitiously intercept, damage, delete, access without authority or expropriate any system, data or personal information on the site;
6.Create a liability for us or cause us to lose the services of bidforme.com.au'sISPs or other suppliers.
7.Fail to complete all transactions entered into by you.
8.Use any device, software or routine to bypass interfere or attempt to interfere with the proper working of the bidforme.com.au site or any transaction being conducted through the bidforme.com.au site.
9.Take any action that imposes an unreasonable or disproportionately large load on bidforme.com.au's infrastructure.
10.Copy, reproduce, modify, or publicly display any content from bidforme.com.au's site without the prior written permission of bidforme.com.au;

bidforme.com.au's Remedies

If you do not perform or comply with any obligation under this agreement, bidforme.com.au is entitled to remedy your breach and recover damages for loss caused by your breach of the agreement, by:

1.issuing a warning to remedy your breach;
2.suspending (either temporarily or indefinitely) your Membership;
3.refusing to provide bidforme.com.au's services to you;
4.terminating your Membership Account; and
5.suing you for loss and damage.

2.bidforme.com.au relies on your continued observance of the Terms and Conditions. If bidforme.com.ausuffers loss and/or damage or incurs any costs in connection with any breach of the Terms and Conditions, you agree to indemnify bidforme.com.au, its assigns and successors for those losses, damages and costs.

3.bidforme.com.au's liability shall in any event be limited to the cost of replacement of any Item purchased by a Successful Bidder.

APPENDIX I

To be able to place a bid in a bidforme.com.au auction, the Member must register on the site first, then when you have found the item that you wish to bid on click on bid now and you will be taken to a seperate paypal secure payment gateway to pay for the admin fee for that auction, once payment has been made your will click on return to the website link and it will take you to bid now section where you will proceed to place your bid on that item.

When you place a bid in a bidforme.com.au auction, prior to confirming your bid, you will be advised of your bid amount and of the admin fee that you will pay using the paypal payment gateway.

APPENDIX II

In a Lowest Unique Bid Auction, it is the lowest unique bid received, which is the only bid at that amount which is the Successful Bid. See below for example;
